ARTICLE 2 – SUBJECT The subject of this contract is to determine the rights and obligations of the parties regarding the sale and delivery of the product or service specified below, which the Buyer ordered electronically from the www.fitzfood.com website of the Seller.

ARTICLE 4 – GENERAL PROVISIONS 4.1. The Buyer agrees that he/she has read and understood all preliminary information regarding the basic qualities of the products subject to the contract, sales price and payment method and delivery on the website www.fitzfood.com. 4.2. The product or service subject to the contract is delivered to the address specified by the buyer within the committed period from the date of order. 4.3. During delivery, the buyer must check that the product is intact, complete and correct. In case of shortage or damage, the seller must be notified within 24 hours of delivery.

ARTICLE 5 – RETURN, EXCHANGE AND REFUND TERMS Article 5 – Returns, Exchanges and Subscription Cancellation 5. 1. In case of deterioration, damage or incorrect shipment of the products, the seller must be notified within 24 hours of delivery with the photographs of the products. 5.2. Product returns are not accepted due to the personal preferences of the buyer. 5.3. For subscription cancellations, a service deduction is calculated based on the daily rate of the shortest package price closest to the purchased package. An additional 10% fixed expense deduction is applied for the time used and the remaining balance is refunded within 15 business days. 5.4. At the end of the 60-day period following the subscription start date, even if the usage right of the package created has not been completed, no refund request is accepted. The maximum usage period for all packages is 90 days. At the end of this period, unused rights are forfeited and cannot be refunded. 5.5. All Inclusive Diet Counseling and Catering Service: Refunds will be made only on the meal service fee, the counseling fee will be deducted. Pursuant to the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, there is no right of withdrawal in personalized counseling services whose performance has begun. In this context; dietitian consultancy, measurement, reporting and consultancy meetings cannot be returned. However, the fee for the days not used for the catering service will be calculated and refunded in accordance with the subscription cancellation conditions.

ARTICLE 6 – ORDER CANCELLATION 6.1. Order cancellation must be notified at least 48 hours before delivery. Orders in the preparation or delivery stage cannot be canceled.

ARTICLE 7 – CONFIDENTIALITY 7.1. The information provided by the Buyer will only be used for the purpose of providing products and services and will not be shared with third parties.

ARTICLE 8 – RESOLUTION OF DISPUTES Izmir Courts and Execution Offices are authorized for any disputes that may arise regarding this contract.

ARTICLE 9 – EFFECTIVENESS This agreement enters into force as of the date the buyer approves the order electronically.

The BUYER declares electronically that he / she has read, understood and accepted all the conditions written in this contract.
